These Terms of Service ("Terms") govern your access to and use of aurumdatapacks.com (the "Site") and any data products purchased through it (each, a "Data Pack"). By purchasing a Data Pack or otherwise using the Site, you agree to these Terms.
1. Who May Purchase
Data Packs are sold for business use only, to businesses and licensed professionals operating in industries including health insurance, life insurance, and real estate. By purchasing, you represent that you are acquiring the Data Pack for legitimate business purposes and that you have the authority to bind your company to these Terms.
2. License Grant
Upon purchase and full payment, Aurum grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Data Pack solely for your own internal marketing, sales, and outreach purposes. You may not resell, re-license, sublicense, redistribute, rent, lease, or otherwise make the Data Pack (in whole or in part) available to any third party.
3. Your Compliance Obligations
You are solely responsible for your own compliance with all applicable laws when using a Data Pack to contact any individual, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, state Do-Not-Call registries, state data privacy and data broker laws, and any industry-specific regulations (e.g., RESPA for real estate/mortgage, or state insurance solicitation rules). Aurum describes where its data comes from in its Data Source Disclosure. Data Packs are compiled marketing data: they are not opt-in leads, include no consent from any individual to be contacted, and are not scrubbed against any Do-Not-Call list. It remains your responsibility to independently confirm that your intended use is lawful, including maintaining your own suppression/DNC lists and honoring opt-out requests directed to you.
4. No Guarantee of Results
Aurum does not guarantee response rates, conversion rates, accuracy of every record, or any specific business outcome from use of a Data Pack. Data Packs are compiled from the sources described in our Data Source Disclosure and may contain inaccuracies, outdated information, or duplicate entries.
5. Digital Delivery
Data Packs are delivered electronically. No physical shipment is made. See our Refund Policy for details on the (limited) circumstances under which a refund or replacement is available.
6. Prohibited Uses
You may not use a Data Pack to: violate any applicable law or regulation; harass, defraud, or deceive any individual; discriminate on any basis prohibited by fair housing, fair lending, or fair insurance practices laws; transfer the data to any third party; or make any decision about a person's eligibility for credit, insurance underwriting or rating, employment, housing, or tenant screening, or for any other purpose covered by the Fair Credit Reporting Act. If you breach these Terms, your license ends immediately and you must delete the Data Pack and all copies.
7. Intellectual Property
The Site, our branding, and the compilation and organization of each Data Pack are the property of Aurum and protected by applicable intellectual property laws.
8. Disclaimer of Warranties
DATA PACKS AND THE SITE ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AURUM'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF A DATA PACK OR THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE DATA PACK GIVING RISE TO THE CLAIM. AURUM IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING ANY LIABILITY YOU INCUR AS A RESULT OF HOW YOU CONTACT INDIVIDUALS IN A DATA PACK.
10. Indemnification
You agree to indemnify and hold Aurum harmless from any claims, damages, or expenses (including attorneys' fees) arising from your use of a Data Pack in violation of these Terms or applicable law.
11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Hillsborough County, Florida.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance.
